بموجب استخدامكم لمنصة الصكوك الحديثة، فإنكم تقرون ببلوغ السن القانونية (18 عاماً) والأهلية الشرعية والنظامية الكاملة لإبرام العقود والالتزامات المالية في المملكة العربية السعودية.

By accessing and utilizing the Modern Sukook platform, you explicitly declare that you have attained the legal age of majority (18 years) and possess full legal and regulatory capacity to execute binding financial contracts within the Kingdom of Saudi Arabia.

تمنح العضوية الموثقة حق الوصول للمزادات المتاحة وقنوات البيع المباشر. يقتصر كل حساب على شخص طبيعي واحد بصفته الأصيلة، ويُحظر تماماً مشاركة أو تداول بيانات الاعتماد السرية لحماية أمن المحفظة.

Verified investment membership grants access to active auctions and direct sales channels. Each account is strictly restricted to a single natural person acting in their personal capacity; sharing or transferring security credentials is fully prohibited to preserve wallet security.

تمثل منصة الصكوك الحديثة جهة وسيطة مستقلة لتنظيم وتسهيل التعاملات الاستثمارية بين البائعين والمشترين. تقتصر مسؤولية المنصة على سلامة البنية التشغيلية والتقنية وإصدار إشعارات التسوية المصرفية، بينما تقع المسؤولية الكاملة لمطابقة الأوصاف والمعاينة الفنية للأصول وتسليمها على عاتق البائع المالك.

Modern Sukook operates strictly as an independent intermediary platform facilitating transactions between buyers and sellers. The platform's liability is confined to maintaining operational infrastructure, technical security, and issuing settlement clearing notices, whereas asset specifications, physical condition warranties, and actual delivery reside solely under the asset owner's responsibility.

تخضع كافة الأصول الاستثمارية لإجراءات فحص وفلترة أولية لضمان الامتثال لمعايير الإدراج المعتمدة، وتحتفظ الإدارة بالحق المطلق في رفض أو تعليق إدراج أي أصل دون إبداء أسباب.

All investment assets undergo rigorous preliminary vetting to ensure adherence to listing guidelines; the platform retains the absolute right to decline, suspend, or revoke any asset listing without prior notice or justification.

تُفتتح القنوات التنافسية بناءً على السعر الافتتاحي المعتمد من المالك، ولا تُقبل أي مزايدة نشطة في السوق إلا بعد قيد وتأكيد الضمان المالي المسبق. يعتبر العرض الأعلى المسجل عند الإغلاق التلقائي للمزاد إيجاباً وقبولاً نظامياً ملزماً لجميع أطراف المعاملة.

Auctions open based on the reserve price authorized by the asset owner; no active bids are registered without clearing a prior security deposit hold. The highest valid bid recorded at the closing time constitutes an absolute, binding regulatory offer on all counterparties.

يمتنع على مالك الأصل سحب أو تعديل شروط الأصل المدرج فور تسجيل أي مزايدة نشطة. يتم توجيه إشعار الترسية الفوري للفائز مع منحه مهلة محددة أمنياً لإتمام التسوية الكاملة، ويعتبر انقضاء المهلة دون سداد نكولاً نظامياً يستوجب إنفاذ الإجراءات الجزائية لسياسة الضمان المالي.

Asset owners are strictly prohibited from withdrawing or modifying a listed asset once an active bid is registered. Upon closure, an immediate award notice is routed to the highest bidder with a strict payment window; exceeding this threshold is categorized as default, triggering deposit forfeiture protocols.

تتيح قنوات البيع المباشر الاستحواذ الفوري على الأصول بسعر ثابت ومحدد مسبقاً عبر خيار الاستحواذ المباشر. يتم حجز الأصل مؤقتاً فور تأكيد المعاملة، ويتعين سداد القيمة الكاملة خلال الإطار الزمني المحدد لتفادي إلغاء الحجز تلقائياً وإعادة طرح الأصل للعموم.

Direct sales channels enable immediate asset acquisition at a fixed, predefined value. The asset is temporarily reserved upon transaction confirmation, and full settlement must occur within the mandated window to prevent automatic reservation cancellation and re-listing.

يتم معالجة وتسوية كافة العمليات المصرفية والتدفقات النقدية عبر قنوات وبوابات دفع إلكتروني مرخصة وممتثلة للأنظمة والمعايير الرقابية السيادية. تقبل المنصة الشبكة السعودية للمدفوعات (مدى)، البطاقات الائتمانية العالمية، وقنوات السداد الرقمي المحمية.

All banking clearance activities and cash flows are processed through licensed and regulated payment gateways strictly compliant with sovereign regulatory frameworks. Supported networks include Mada, international credit cards, and protected digital wallets.

يتم الإفصاح عن الرسوم والمصاريف التشغيلية بوضوح تام عبر صفحة بيان الأصل قبل تأكيد أي معاملة مالية، ولا يتم حفظ أو أرشفة معطيات الدفع الحساسة في أنظمة المنصة مطلقاً.

Operational and platform service fees are fully disclosed on the asset listing page prior to final transaction authorization; sensitive financial credentials or cardholder data are never stored or archived on local networks.

يُحظر تماماً تقديم عروض وهمية، أو التواطؤ للتلاعب بالقيمة السوقية للمزادات، أو استخدام هويات وحسابات متعددة للتأثير على عدالة التنافس، وتعتبر هذه الممارسات مخالفة نظامية جسيمة تستوجب حظر الحساب فوراً وإحالة المعاملة للجهات المختصة لأغراض الحماية المالية.

Submitting fraudulent bids, conspiring to manipulate auction asset values, or exploiting multiple accounts to impact market parity is strictly prohibited. Such acts constitute serious regulatory violations resulting in immediate account termination and legal escalation for financial protection.

يلتزم الشركاء والمستثمرون بعدم إدراج أي بيانات مضللة أو إفصاحات غير دقيقة في بطاقات الأصول، أو ممارسة أي سلوكيات تندرج تحت طائلة الاحتيال المالي الإلكتروني.

Counterparties and users commit to providing entirely accurate disclosures within listing profiles, refraining from deploying misleading descriptions or engaging in any conduct categorized under electronic financial fraud.

تحتفظ الإدارة بالحق المطلق في تعليق أو تقييد صلاحيات أي محفظة استثمارية عند الاشتباه في ممارسات احتيالية أو الإخلال ببنود هذه الشروط والأحكام. يتم إرسال إشعار رسمي بالتدبير المتخذ عبر وسائل الاتصال الموثقة مع منح مهلة للتظلم والتحقق مدتها سبعة أيام عمل.

The platform retains the absolute right to suspend, restrict, or terminate any investment wallet upon suspicion of fraudulent practices or direct breaches of these Terms & Conditions. Formal notice will be distributed via verified channels, granting a strict seven-business-day window for dispute verification.

عند تصفية الحساب وإغلاقه نهائياً، يتم مقاصة وتسوية المستحقات المالية الصافية للعميل، بعد حجز واستقطاع أي مبالغ مرتبطة بالتزامات قائمة، أو عمليات قيد التسوية، أو نزاعات منظورة قانوناً.

Upon final account closure and liquidation, net remaining balances are cleared and paid post-deduction of any outstanding liabilities, active clearing obligations, or unresolved legal asset disputes.

لا تتحمل منصة الصكوك الحديثة أي التزامات مادية أو تعويضية ناتجة عن انقطاع الشبكات التقنية، أو توقف بوابات الدفع الخارجية، أو الأخطاء الفنية الواردة في مستندات الإفصاح المعتمدة من البائع. يقتصر الحد الأقصى للتعويض الائتماني في كافة الأحوال وبشكل قطعي على القيمة الإجمالية الصافية للمعاملة محل النزاع.

Modern Sukook accepts no financial liability or compensatory obligations arising from technical network disruptions, external gateway outages, or technical discrepancies found within disclosure documents verified by the seller. The maximum credit liability is strictly and absolutely capped at the net transaction value under dispute.
